ReplyDeleteCan you afford a lawyer to help with your disability claim? Absolutely. You can't afford to be without one. A representative cannot charge you a fee unless you win, and even then, his fee is limited by what the Social Security Administration will approve. Any attorney fee comes out of back pay you receive. The fee can never exceed 25 percent of the back pay.
ReplyDeleteBasic Requirements for SSDI benefits: (a) You are not currently working and earning at least $1,180 per month. If so, you can't apply. (b) You have a severe medical condition supported by medical evidence. (c) Your impairment has lasted, or is expected to last for at least 12 consecutive months OR to end in death. This is called the "duration requirement." SSDI does not cover short term illnesses that last less than 12 months. Basically, you must be unable to work at any full-time job that exists in the national economy.
ReplyDeleteMay disabled veterans get SSDI in addition to full VA benefits? The good news is YES. Veterans are covered by both Social Security disability insurance and VA disability. One does not interfere with or reduce the other. If a vet has a VA/military disability rating of 70 percent or above, there is a very good chance that he or she will also qualify for SSDI benefits, too. Call me at (256) 799-0297.
ReplyDeleteWhat to look for in a disability attorney or advocate: (1) Experience. (2) Dedication = a willingness to work hard to develop your case. (3) Access. Hire someone who is local and you can meet him/her early on, sit down in the office and plan your case. Why trust an unseen face on the end of a lost distance 1-800 number? "An advocate I can see is GOOD FOR ME."
